Policy on the use of data on author-managed platforms
1. Introduction This policy sets out the strict conditions for the use of content published on author-managed platforms ("platforms"), including, but not limited to, websites, forums, blogs, media channels and other types of online publications. The policy is mandatory for all entities, companies and individuals that access, use or process information available on these platforms, for purposes such as:
Training artificial intelligence (AI) models;
Creating datasets for automatic processing;
Improving machine learning algorithms;
Other related activities.
2. Licensing and explicit consent
2.1. Any use of information published on the platforms is prohibited without the prior, direct and written consent of the author.2.2. Consent can only be granted through a formal, legally documented agreement between the author and the user.2.3. Any attempt to use the data without such consent will be considered a serious violation of this policy and relevant international law.
3. Retroactive applicability This policy applies retroactively to all previous uses of the data published on the author's platforms. Entities that use or have used the information without consent will be obliged to immediately remedy this situation by paying compensations set by the author.
4. Consequences for violations
4.1. Any unauthorized use of the data will attract a minimum penalty of EUR 100,000, adjustable at the author's discretion, depending on the severity of the violation.
4.2. If the user refuses to pay or challenges this policy in court, the minimum penalty will be increased to 10 times the initial amount (EUR 1,000,000), to which will be added all legal costs and other expenses incurred by the author.4.3. Users who violate this policy will also face additional legal consequences, including civil and criminal penalties, as applicable in the applicable jurisdiction.

6. Prohibited Indirect Use and Related Practices
6.1. Indirect use of data is strictly prohibited, such as:
Partial or anonymized processing of data to avoid identifying the source;
Creating derivative datasets based on information published on the platforms.6.2. Any entity involved in such practices will be subject to the same sanctions provided for direct uses.
7. Mandatory applicability Accessing or using any information on the author's platforms implies full and unconditional acceptance of this policy. Refusal to comply with the policy does not exempt the user from responsibility.
8. Disputes and out-of-court settlement
8.1. In the spirit of efficiency, disputes related to the violation of this policy must be resolved out-of-court through direct negotiation.
8.2. If the dispute reaches court, users will bear all legal costs and penalties will be increased according to section 4.2.
9. Exclusions and Limitations This policy does not apply to uses authorized by prior written and signed agreements with the author or other explicit legal contracts.
10. Contact and Reporting For requests for consent or reporting violations, users are required to contact the author via the details provided on the platforms. Failure to comply with this requirement constitutes a further violation.
